The previous year had witnessed the reported death of a woman at Tiller's abortion clinic and filthy conditions an abortion clinic in Kansas City, Kansas.  These events have led the Kansas Legislature to pass HB 2503 which is almost identical to the 2003 clinic regulation bill.

The Senate had changed some of the wording on the bill, so the House had to vote on the bill again in a procedural vote called a "Motion to Concur and Nonconcur."

Late on the afternoon of Friday, April 15, 2005, Governor Sebelius vetoed the billSebelius has taken over $38,000 in contributions from Tiller.

Sebelius justified her 2003 veto by claiming, "Kansans experience and appreciate some of the highest standards for medical care in the country."  But after the revelations of at least one patient death at Tiller's clinic and revelations of filth in a Kansas City abortion clinic, Sebelius changed her tune.  Thsi time, she claimed that she vetoed the bill because it regulated only abortion clinics and not other types of surgical centers:

Two Representatives had voted against the bill upon its original introduction on March 21st, but then they voted for the slightly-reworded version of the bill on March 31st.  These two Representatives then switched again and voted against the attempt to override the Governor's veto.  Those two Representatives are listed below:

Following is a press release by Kansans for Life.  This press release was written after Sebelius vetoed the bill but before the House voted on the override.

RESPONSE to  Governor Sebelius' VETO of HB 2503 (abortion clinic licensing)

And signing of the Stan Clark Pregnancy Maintenance Act and The Child Rape Protection Act

Attribute to Mary Kay Culp, Executive Director, Kansans for Life:

"Governor Kathleen Sebelius' veto of HB 2503 cements her Kansas legacy as the Governor who protected the abortion industry instead of protecting women, but this isn't surprising given the financial support she has received from that industry in every one of her political campaigns.

"Other Clinics" Claim is Bogus
"The Governor claims she vetoed clinic licensing because it didn't include all clinics, but the problems that have come to light hasn't been with the other clinics, it's been with the abortion clinics: dead rodents, pre-loaded syringes, carpeting in operating rooms, no monitoring equipment, human parts in the refrigerator next to food, etc. She should be ashamed because if ever there was a situation where it was incumbent upon the state to protect the vulnerability of the consumer, this is it.

"Abortion is unique and unlike other medical procedures, primarily because it takes the life of the unborn baby. In  the practical sense, abortion is an invasive, bloody procedure with many kinds of injuries--yet, there is little chance of malpractice lawsuits because no matter how badly they are treated or injured, most women are desperate to keep their abortions secret.  They know abortion at-any-cost supporters like Sebelius, will protect them from state oversight. Thus, unlike other physicians, abortionists are much more tempted to ignore basic safety and sanitation standards, and to cut corners that saves time which can then be spent doing even more abortions, and making even more money. 

"In 2003 Sebelius vetoed this bill because she said Kansas already had the highest medical standards.  Today she vetoed it saying just the opposite-that she couldn't sign it because it was needed for every medical clinic. It's nothing more than an excuse for not signing a bill that her list of abortion campaign donors doesn't want her to sign. The Courts have repeatedly said that the state may regulate abortion clinics even if they regulate no other medical office. [Greenville, S.C., 2001]

Points in Veto Message are Wrong
"Governor Sebelius' veto message of HB 2503 got other major points wrong as well. Yes, HB 2503 was passed by legislators (politicians as she calls them), but it is a matter of indisputable fact that HB 2503 was designed by doctors.  Federal courts have at every turn said the language of HB 2503 accurately reflects the abortion industry standards. It was derived from the published standards written by Planned Parenthood and the National Abortion Federation, and even matches them in places word for word.

"HB 2503 wouldn't be enforced by "politicians" as Sebelius said. It would be enforced by the Kansans Department of Health & Environment-the same agency entrusted to inspect and license nursing homes, surgery centers, hospitals and even the popcorn we eat in theaters!  In all those situations, KDHE is not overseeing their professional buddies, and micro-managing the deficient ones at tax payer expense, like the Board of Healing Arts currently does.

"If HB 2503 had been in effect last year, the KDHE would have known something was wrong at Tiller's clinic long before the fourth ambulance transport of the year which ended up with a young woman dying at the hospital. 

There was a fifth ambulance transport on February 17 of this year, and some observers think it also was a death, but we may never know because the only people reporting these events currently are pro-life protestors with video recorders whom the media ignore because they have no official status.  On the other hand, HB 2503 would mandate the reporting of injuries within 10 days, and deaths within 24 hours, to the Kansas Department of Health.

"Currently, the only official oversight of Kansas abortion services is the Board of Healing Arts' control over a doctor's professional license, which they pull very rarely, very reluctantly and very reactively-long after something has gone wrong.  As an overwhelming number of our Kansas legislators realized, Kansas needs HB 2503's requirement that KDHE allow a facility to open only after passing inspection. With an impartial checklist, a substandard facility can be closed-something that cannot happen now.

"All three bills are more than reasonable and should be able to be supported by anyone on either side of the abortion issue, except extremists.  Thus the governor's veto of a bill passed by an overwhelming majority of legislators says a lot about how out of step she is with the citizens of Kansas.   None of these bills limits the free choice of abortion in any way, shape or form. And none of these bills will result in fewer abortions except in those clinics where rushing more women through in order to make more money has been put ahead of following medical standards.

"The forces fighting clinic oversight the hardest are the very same voices who claimed we must legalize abortion to make it safe!

"Sebelius' 2003 veto, prohibiting inspection of abortion clinics, has allowed a Kansas City, Kansas abortion clinic to operate with roaches on the counter, dried blood on the floor, and clutter everywhere, with the blessing of the state Board of Healing Arts. Sebelius has never decried this clinic, even though clinic photos from August 2003 authenticated the filth and chaos.

"The Board of Healing Arts' stated aim is to keep physicians in business, even after damning evidence is hand-delivered to them. After receiving the photos, the Board took one entire year, to formally acknowledge the clinic was substandard. They nevertheless allowed the abortionist to continue his practice there under their supervision.

"Despite six "consultation visits" from the Board this year, this same notorious KCK clinic was still dirty two weeks ago, with a dead rodent in plain view! Outdated medicines and syringes pre-filled with unlabeled narcotics were also found -- violations documented in other Kansas abortion clinics. Abortionist repeated non-compliance with Board instructions will never be remedied until the state can remove a business license.

"The Board is a reactive state agency that can only act on evidence brought to them, which rarely occurs in the abortion arena for several reasons. The majority of women in abortion clinics visit once and don't return. Nearly half of all women who obtain abortions in Kansas live in other states and countries. As mentioned previously, combined with the social stigma of abortion, this allows for a veil of secrecy and a lack of accountability.

"Since the governor can no longer credibly claim Kansas clinic standards are impeccable, she now asserts all doctor clinics need regulation, and that abortion clinics cannot be addressed until that occurs. But it is clearly and routinely the abortion clinics in Kansas that have been found not following sanitary practices and lacking medically trained staff and emergency equipment.

"There is no medical crisis in Kansas doctor offices for which any evidence has been brought to the Capitol. Year after year, the documented deficiencies have been in abortion clinics. How many more deaths are needed?

"The Governor's excuses are inconsistent and lack factual basis. They betray her support for abortion no matter what the danger to women. Kansans for Life most strongly urges citizens to contact their legislator to override the Governor's veto of HB 2503."
