Currently, Kansas abortion clinics are not licensed nor inspected. The current oversight of abortion clinics comes only from the Kansas State Board of Healing Arts which licenses doctors but does not inspect nor license clinics, does not set clinical standards, and does not keep records of injuries nor maternal deaths except if a lawsuit is filed.

For several  years, the Kansas State Legislature has proposed legislation that would regulate abortion clinics. The proposed legislation would establish basic requirements for medical equipment, record keeping, staffing, and such. For example, any clinic that performs a second or third trimester abortion must have a sonogram machine and must keep all sonogram prints. The bill would have required that maternal injury and maternal death be reported to the State. (Click here to read a complete copy of the 2003 bill.) 

This legislation easily passed the State House and the State Senate in 2003 and again in 2005.  But both times, the legislation was vetoed by Governor Sebelius who has taken has taken over $38,000 in political contributions from Tiller.  In 2004 and 2006, some legislators used procedural tricks to sidetrack the legislation.  The legislation was not reintroduced in 2007, but Sebelius did veto a different abortion bill and was nearly overridden.
