Tiller's website only advertises "2nd Trimester Elective and 2nd/3rd Trimester Therapeutic Abortion Care". But Tiller is willing to perform purely elective late-term abortions.

"Elective" means there is nothing wrong with the baby, and the mother's health is not threatened by the pregnancy. In other words, an "elective" abortion means the mother just doesn't want the baby.

Notice what Tiller says on his website, "Viability is not a set point in time.  Viability is determined by the attending physician ..."  In other words, the abortionist determines if a baby is viable... if the baby is able to survive outside the womb.

In 2001, Tiller made a video that is given to women as they arrive in Wichita for late-term abortions.

This video is entitled, "Philosophies and techniques of late term abortion services at Women's Health Care Services".  In this video, Tiller talks openly about the reasons women come to Wichita for late-term abortion which include "occupational issues" and "financial issues".

Your presence here this morning means that something is going dramatically wrong in your life. You may be here to end a pregnancy early because of fetal abnormality to save your unwell, unborn child from a lifetime of pain, suffering, disability, and hardship.

On the other hand, you may be here because of some of your own issues of survival. You may have issues of domestic violence: rape, incest, spouse abuse, or child abuse.

You may have issues of your own health. You may have some serious disease process: cancer, lymphoma, diabetes, high blood pressure, heart disease, or any one of a number of the other medical problems that can afflict women of child bearing age.

You may have some issues of age yourself. You may be 9, 10, 11, 12, 13, 14, 15 years of age. On the other hand, you may be at the end of the other spectrum of fertility. You may be 40, 45, 50, 55, or even 60 years of age.

There may be some issues of poverty such as homelessness. You may have some occupational issues. You may have some financial issues.

But, for whatever reason that you are here... we find that there are many reasons why women find that continuing the pregnancy will cause substantial and irreversible impairment of their physical health, their mental health, their emotional health, their family health, age of the patient, safety and well-being... for whatever reason that you are here, welcome to Wichita, and thank you for the opportunity to be helpful to you.

Tiller requires women to sign several consent forms before their abortions.  A paragraph from one consent form (shown below) proves that Tiller calculates the gestational age of the baby solely upon his own sonogram analysis.

Luhra (Tivis) Warren, a former Tiller employee, wrote the following:

"I was required to falsify the medical records. But not just that, related to that, I was required to lie to the women over the phone. And the way he'd explain it to me was, without coming right out and saying it, these are really third trimester abortions, but we're going to tell them they're only in the second trimester. They would say, well, I've already had a sonogram, and my bpd was 7.8 or 8.3 or whatever. He said, when they tell you that, don't turn them away as being too far along. Tell them to come in, and we'll do our own sonogram, and it will show they're not that far along. Tell them that sonogram reading is an art, not a science. He explained to me that the bpd is a measurement of the angle of the baby's head, where at that angle, the baby's head is roughly egg-shaped. The usual way that you measure the bpd is from the top of the egg to the bottom of the egg, which is at the widest point. Proposed state legislation would require that clinics follow "established standards of care" when estimating the gestational age of the baby.  The proposed legislation would also require the clinic to keep the original copy of the sonogram print on file.

This would have deterred abortionists from falsifying the gestational age of the baby. However, Kansas governor Kathleen Sebelius vetoed this legislation.

In a 1995 speech, Tiller admitted that not all the abortions he does are for fetal abnormalities.

"We have some experience with late terminations: about 10,000 patients between 24 and 36 weeks and something like 800 fetal anomalies between 26 and 36 weeks in the past 5 years."

Kansas law states that a late-term abortion can be performed only when "a continuation of the pregnancy will cause a substantial and irreversible impairment of a major bodily function of the pregnant woman." (K.S.A. 65-6703)

Paul McHugh

Dr. Paul McHugh is a Professor of Psychiatry at the Johns Hopkins University School of Medicine.  McHugh was hired by the then-Kansas Attorney General Phill Kline to review some of Tiller's records.
